Well... I was really looking forward to the weekend....

I was going to do a photoshoot with my co-worker who has a sexy sexy Audi down at VIR... We were then going to go to NC and spend the weekend with my brother. I figured this could be my chance to expand my portfolio and get some exposure as well... Well as destiny has it... twas not to be...

I was on my way to Tj's in Alexandria, enjoying some wedding toones and the day. Sunroof down, enjoying my beautiful car and all that good stuff. I even had my Subie shirt on! Anyway... I turned the tunes down as there was a lot of traffic on Duke st (still a noobie stick driver so I get nervous with traffic and music). I make a left onto St. Asaph and cruise down... some pedestrians and cars got in the way but I was patient. Shoot... it's friday! I'm totally laid back!

Get to the third or fourth block from TJ's and I am pretty sure I got there about 1 second before this lady.. So no one else was at the four-way but me and her. She signals me to go,I raise my hand in appreciation... next thing I see is this BIG ASS SUV coming towards me... FAST and I am like WHAT THE ****! and I swirve to the left but no good. I got t-boned and was pushed diagonally across the intersection. WHAT THE ****!!!!! is all I kept yelling. The damage was done. My car got ****ed up...

Everyone was ok, she didn't seem too too shaken up and asked me if I was ok. She claimed she thought I had waved her on and I was like "No I was thanking you for letting me go..." I could barely stand up after the accident. I didn't even want to look at my car. We were in the middle of the intersection. So she gets in her car to move and she is sooo pinned into me that she had to do some serious effort to pull out... omg, so I back up and course... the moron I am backed into the wrong side of the street (no accident so dont gasp), but this "lovely" couple drives by and yells at me for my incompetency to park on the wrong side of the road blocking traffic, so I am like "dont you see my car? We just got into a ****ing accident! See that car over there? Thanks for your 'kindness'."

Well long story short, I'm fine. Im shaken up, angry, im hurting and heartbroken from seeing this....

Oh, wow! I'm gald your ok though! Sucks your car was hurt to badly! I don't trust drivers, specially if I'm making a left at a light/stop sign. I hope you can get it back on the road soon and without to much insurance issues!

I actually saw the commercial the night I came home from the accident and it made me cry but when I went to the tow lot, I took the case from my passenger mirror which popped off when she hit me. I'm going to make it a candy dish lol.

Thanks everyone for the kind words. The officer didn't label anyone at fault, but I have a surveilance video of the crash which I am going to drop off at the precinct. I watched it and she just dragged me accross the intersection big time. The one question I wish I could have asked her was "How did you not see me?" ( I was in such a huge shock I could barely speak at all)

It honestly felt like a full blow to the side. By the way the video looked and the way it happened, she didn't even look like she tried to break or swirve. If you see me, I tried to swirve out of her way but she took me out on the side.

Oh well... More to follow I guess... Im so bummed. I feel naked without my car and today going back to where it happened to pick up the surveilance tape sucked big time... I couldn't stop crying and my stomach was upside down... unfortunately, I dont think Ill be able to go down that side of town for a long time....:(

Glad you are ok. Did you have the right of way? I got into an accident end of last year. My 4Runner was completely totaled and I have a rad scar on my shin.

Lol um... my husband already claimed them :)

I dont think the car is totalled at all but the whole side is messed up. They are towing her today from the lot to go to the body shop where the insurance person will come see it. Sooo .... Im pretty sure I had the right of way because I got to the stop sign a second or so before her (four way) and she signalled me to go. Guess the confusion came in where I thanked her because she thought I had waved her on.

Then thats when I get plowed.

I do have a surveilance tape which when all is said and done, ill probably post

Good luck to you, it's usually a bit easier to win a case if the cop cited someone. Hopefully the surveillance tape comes through in your favor. Do you think the actual frame is tweaked? Looks like most of the damage was from the door, so you should be okay. Thank goodness you are okay and the airbags didn't go off.

The fact that she hit you on your front door should make her at fault when the insurances go at it, so hopefully you'll be deductible free! :)

When I was rear-ended the first time around, I had a realllllly hard time going to that area again. I actually had to go down there today and I had a slight flashback and I felt a little uneasy...

Thanks for all the responses. Atleast my car got towed today from the wreck lot to the shop where the work will be done. Got a few shops recommended but the one that stood out the most was one thats used by one of the subie dealerships. So if they work with subaru they should know what they are doing. The claims adjuster person should be coming out to asses the ouch... I'm guessing ten grandish...

Estimates came back at 6800 so far... the shop explained that normally they do an estimate but it always ends up being more cuz of hidden damages... or something like that. Its gonna be about 21 days that she'll be in for car surgery... but as an early birthday present Im going to get her a new grill to match her paint color and maybe some hellas?

Actually I am looking into doing some similar cosmetic things as you did. Headlights and rims :) I also want a louder exhaust, sway bar (got to talk more with my hubby about what to get specifically), hellas and a new grill (white one to match the car). I may also swap the shifter and get a smaller shifter and change the boot and nob to match the interior of the car (black with red stitching). Something else I want: mudflaps

That price is pretty spot on to be honest, the door shell is 350$, the interior mold is about 299$ and then you need the regulator and all of that stuff to go inside the door. Easy fix to be honest but since you're not at fault why worry.

Kind of shocked that they are using the square protection bar. Wonder why they went from the round tube to that. You'd think the round brace would be less likely to bend... odd, glad you're okay.

So here is an update from the insurance. The are going to move forward with faulting us both on the count that according to VA law the other driver had the right of way.... now my question is... according to the surveilance video, why would I have come to a full and complete stop at the stop sign??? I obviously had no intention of breaking the law... and if so why didnt the other driver go while I was stopped? Anyway, they said they are faulting us both because we miscommunicated and were both in the intersection when the accident happened... now here is my question... Who T-boned who? I didn't T-bone her, I tried to swirve, she plowed right into me... so wait... isn't that breaking a VA law that you are supposed to proceed cautiously through an intersection? mmmm....

Anyways... Shop says she wont be ready til first week of June... my rental is covered through the last week of May...

Thoughts on what I should do now?

I am only guessing that the square bare is much easier to stamp and therefore cheaper to produce.

For the record I hate stupid people with a passion. I don't see how the other driver was not at fault 100 percent.

I, too, wonder why the other driver wasn't at fault seeing as SHE HIT YOU. Anyway, I suppose it's moot now. I'm glad you're okay. You will miss your car so much when you finally get it back that you'll really enjoy it for awhile - that's something to look forward to, I guess. :)

I think the insurance company needs to re-think this. You're all at a four way stop, miss communication or not the fact that she ran into you with such force to cause that much damage is ludicrous. I've had miss communication on a four way before and we both stopped. The guy was pissed gave me the finger etc... but when you're at 0mph you should be able to stop on a dime. The fact that she ran into you and pushed you is just madness. This is why I hate insurance companies... they'll protect you but they'll rape you as well... instead of being their. I have one insurance company and I keep track of all the bills I pay them. Insane? When you have a mortgage and a few assets in your life I'm curious to see how much I threw away on insurance. When they have about 278,000$ of your money over the years and then they won't fix a freaking cosmetic issue I throw that in their face and ask them why I even bother with the agency. I wouldn't sweat it, if they're taking care of it then good, they're doing their job. If they want to raise your insurance ask them why. They'll state you're a reckless driver... fight it you might win... if not tell them that you would like to lower your insurance and what do they have for programs. I'm with state farm and I pay 60$ a month on my car. I've been through several of their programs including a 12 hour course where I fell asleep but it lowered my insurance. :)

Thanks for the advice. I never thought of taking a class to lower my insurance. We have usaa and are paying about 110 a month for our WRXs. It was nice cuz when my husband and I got married they droped our rates but now im sure next time around they will jack em up... as i mentioned before, when all is said and done ill post that video....

Yeah... sucked. Shop says first week of June... but that is still to be determined. I have no issues driving, I just can't really drive in Old Town anymore... but that's ok cuz I never liked driving around there anyway...

bleh i hate driving in all old towns.. are you talking about old town alexandria? The one in fairfax sucks too.

Oh man thats horrible. I had a similar incident in a Maryland shopping center a few years back...I seriously dislike those centers. Nobody seems to know how stop signs work. Hope the work on the car can be done quickly and well!

Its just been a nightmare... Cars been gone for over a month... Rental money is up... sharing a car with my husband (not so bad as he drives a WRX too).

It was Old Town Alexandria... I hate driving there. Everyone seems to have a death wish. GAWWWSH

I need to vent!

This whole situation has been a fucking nightmare... just got off the phone with the body shop... there was structural damage to the car which they dont want to just repair because the repair wouldn't be guaranteed for the duration of the car... SO they had to order the parts to replace the damage which I am told takes about 5 business days to arrive... USAA called me last week to let me know I know longer had $$$ for the rental and that further use would come out of my pocket... so I said F that... and returned the car. Had I not called today I would have NEVER found out that they did extend my f'ing rental. In addition I get 50% of the blame for this none sense just because the law says it was my fault cuz I "should have yielded to the person on my right." I got there first, I stopped, I made a thank you gesture for her letting me go, I tried to swirve, I got slammed, I got dragged through the fucking intersection and she gets away with 50% of the fault???? What the fuck! I have no damn car, its been 6 + weeks, we are looking at another two and some how this was my damn fault???? Like what the fuck, I thought you were supposed to drive cautiously thru intersections not take off like you have a rocket in your tail pipe.... and did I mention she had small kids in her car????

I don't see how you should be at any sort of fault. She drove very recklessly. It should be her fault entirely and her insurance should have to pay the costs. Because of some crazy driver your insurance rates are going to go up.

Well today is a better day I guess.

The good news is I have been given a loaner car and its a Forester :-P So i feel much better, plus it drives really nice. Its not the XT but damn its pretty fast, although it has a ton of body lean.

Ummm ya it totally looks like she purpously went right after you started crossing the stop line. It doesnt even look as if she gave a second to check whos turn it was. Shes totally at fault. And theres no way to appeal the insurances decision on itt being a 50/50?

I agree with the "it looks like she purposely went right after you started crossing the stop line". She was probably in a rush to get where-ever.

Unfortunately many drivers are like this. They are in a rush so that you pay for their lack of planning. Others simply do not pay attention and assume that they can "go for it".

Was she on her cellphone by any chance?

You also said she had kids in the SUV. Maybe they were the distraction?

Regardless, since she assumed that you waved her on that she simply went without any respect to being cautious or aware of what else was going on around her.

I Guess she said that I signalled her because she knew otherwise she'd be 100% at fault because she waved me on and I thanked her and went... next thing I know I got slammed.... I mean how the f do you not see me? Itwas just wreckless driving and I got the short end of the stick. If you watch the vid closely after she hits me, she tries to back out of my car BEFORE she came to ask if I was ok. When she did finally come out she seemed unusually calm. Its a frustrating situation and its unfortunate but it is what it is I guess....

Especially when no one immediately jumped out of the cars!!The shop owners (thats how I got the vid) offered to be witnesses but because we both "said the same thing" the officer didnt want to see the vid... The insurance basically didn't change their minds after seeing this so... note to self, I dont give a bleep who is at the stop sign first next time... that person can just go cuz really this has been a hassle and a pain in the ass.

I agree with Sarah!! I was thinking the whole time, "Why is no one coming over to help??" And, you were stopped for plenty of time, so Its not like you just entered the intersection right away without looking! I just cant believe she got going that fast into the interesection. If she had been driving causiously, she would have been able to stop!!

My car is back in the body shop from my accident in September, so I feel ur pain about not being with ur subie!! I miss mine so bad already and it only went back on Saturday :(

Thanks everyone. I will have been without my car for two months this Wednesday. So bleeping crazy. Well around here, people really just dont care and that is why I really do not like the DC metro area... anyways, I made all those points mentioned above to the insurance but it was a no go. I was like I had my day time running lights, came to a full and complete stop, went slow and tried to swirve. WTF more do you want from me???? I mean geez! This could have easily been avoided or far less serious had she been paying attention and not trying to fly thru intersections,.... I bet she even has her car back...

Girl, I totally feel your pain. We've had 2 accidents in our 05 WRX. It sucks. First was less than 3 months after purchasing the car, and the damage looks pretty much exactly like what happen to your car. The second was in March of this year. Got the car back, but the work is jacked up; Im still waiting on them to replace my rear bumper. blah. Best of luck & glad you're okay.

Yeah I read on your post :( I am sorry about your car. SOmeone rear ended my hubby's WRX a few years back and the shop did a horrendous job, its still a little crooked....

You should see my bumper. They never attached it properly in the first place. I think I could have done a better job :lol: (ok, prob. not, but you get my point).

I may be blind and late, but how are you at fault considering if your at a 4-way stop, how the hell did she take you across an intertesection that hard if she was obeying the law? She musta been doing a pretty good speed to do that? Coming from a stop its kinda hard to nail someone? Plenty of room and braking to prevent that?

I shied this with the insurance over and over but it wasn't worth bringing in a lawyer since I wasn't severely injured. I had some minor back spasms from tensing up. Trust me I think the same thing when I go through a stop sign. Well it's all done now but that's why I feel so passionate about people and impatience on the road.

I know I am pretty late on this too but I have the same "flashback" issues when I drive on Spit Brook Road in Nashua, NH. I actually t-boned a Kia Sportage when I had my Hyundai Elantra wagon. No one was actually sited as being at fault but the other guy was really the one at fault. He was taking a left out of a store parking lot and squeezed between a line of traffic, where someone waved him on as I was about a car length away and going the speed limit because there was no one in my lane....on a hill. totaled my Elantra, airbags and everything. My windshield washer fluid container was 30 ft in front of my car down the hill. it was pretty nasty. I STILL have back and neck problems from that.

His insurance claimed that I was 20% at fault because I was speeding. 1. there was nothing on the police report that said I was speeding, in fact he listed the speed limit as more than it actually is. 2. there were no witnesses as they claimed there were because I asked them for the names and numbers and they refused to give them to me. Always hire a lawyer...that is what I learned from that accident. If it's bad enough to do significant damage to your vehicle always always call a lawyer. you can get one of those lawyers that you only pay if you win and they will make sure the other person's insurance company has to pay for his lawyer fees.

It's really rediculous how stupid and incompetant people can be. Accidents are Traumatizing! I've been in 2 Major ones and 1 minor one. Neither of the two majors was my fault the minor was due to ice.

I am glad you got your subie taken care of and that you are alright. I get skiddish any time I have to take a left turn without a stop light and when I see other people ready to dart into an intersection any moment.

The main thing is that the car can be fixed/replaced, you can't be replaced so I am happy you are okay.

The unfortunate thing is that memory will stay with you for years and years. The accident with the Elantra happened in 2001 and it still feels like it was just yesterday.

:( I am sorry about your accident. That sounds terrible. I still can't drive in Old town Alexandria, and if I am a passengar in a car i just lose it. Accidents suck, minor or major... :(

I think I read earlier that you had USAA? We have them as well and what a frickin pain! We pay $100 more up here than we did in Florida (WRX & a Tundra).
I had someone back into my car in Mississippi and the guy had fake insurance cards it took me 10 months to finally get my check from USAA for my deductible as I had to pay $500 out of pocket for the repairs since we were PCSing and you can't have a visibly damage car shipped "overseas"(Alaska=OCONUS). Also, the guys wife (she was the passenger) kept running off to the bathroom and didn't want me to call the cops. I assumed she was ditching her drugs because they appeared to be crackheads(err meth) and the cops just didn't seem to care and didn't even issue them a ticket or anything.

Your video makes me sad I can't believe all the people that just kept going around you that just blows my mind. From what it looked like you were at the stop sign quite a while before she got there. I just can't believe how fast she was going, thats crazy! I understand where you are coming from though it's only so much fighting you can do with the insurance company before you just give it up and attempt to move on. How is it driving now, any difference?

Well, USAA atleast was very prompt in paying my medical bills but it was a downhill battle with them. Video or not they didn't care they used the law against me. It was such bs but like I said it wasnt worth getting a lawyer. She runs great. I had some minor suspension drama last fall because when I got my wheels changed, the shop put my car on the control arm. That was a cluster f*ck because I thought my issues were due to the accident. When finally over a month later I found out what was wrong it was too late to go to that shop and complain. Plus with this accident, they would have just called me crazy and blamed their faulty work on that... So I payed 1200 more than I intended on a wheel swap. Stupid, huh? I was about ready to ditch the car but my husband told me to hang on to her cuz she'd only be worth about 15-17k.... and i honestly didnt want to buy anyother car.

Since then, knock on wood, I've had no other drama. I havent driven back to the site of the accident and probably wont for a long time. I hate stop signs...

But all is good. No major plans for the car since I am a photographer trying to make a living out of her talents! LOL

Im so sorry that this whole situation has and is testing you to your limits.
Its obvious that it pains you knowing sno kone is in sergury and the whole situation effed up.
And its also clear that your being strong about all of this.
I am sooooo glad that you were able to talk away from that accident ( that vid upset and angered me to the core ). So glad you are safe.

I do hope things get sorted out ASAP!

Thank you :) I appreciate your nice comments. I do look at my car as "unique" and "bad ass" now, though :) Gotta joke about it or else I just get mad. But its almost a year now and all is good. Thanks again for such a sweet message :)
